1. Agreement to Terms
By accessing or using Elevate Horizons ("the Service," "we," "our," or "us") at elevatehorizons.com, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Elevate Horizons provides:
- Event Management: Browsing, booking, and managing event registrations
- User Accounts: Personal accounts for managing bookings and preferences
- Payment Processing: Secure payment processing for event tickets and services
- Wellness Services: Access to wellness programs, coaching, and related services
- Communication: Email notifications, newsletters, and updates
3. User Accounts
3.1 Account Creation
To use certain features, you must create an account by:
- Registering with a valid email address and password, OR
- Signing in with a Google account (OAuth)
You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Notify us immediately of any unauthorized account access
3.2 Account Responsibilities
You are responsible for:
- All activities that occur under your account
- Maintaining the confidentiality of your login credentials
- Compliance with these Terms when using your account
3.3 Account Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- You provide false or misleading information
- Your account is used for fraudulent or illegal activities
- We cease to provide the Service

4. User Conduct
You agree NOT to:
4.1 Prohibited Activities
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit viruses, malware, or harmful code
- Attempt unauthorized access to our systems
- Scrape, harvest, or collect user data
- Impersonate others or misrepresent affiliations
- Harass, abuse, or harm other users
- Use automated systems (bots) without permission
- Interfere with or disrupt the Service
5. Event Bookings and Tickets
5.1 Booking Process
When you book an event:
- You agree to pay the stated price at the time of booking
- Bookings are subject to availability
- Confirmation will be sent via email
- You agree to attend or cancel according to our policies
5.2 Payment
- All prices are displayed in South African Rand (ZAR)
- Payment is processed securely through Paystack or Electronic Funds Transfer (EFT)
- Payment must be completed at the time of booking
5.3 Cancellations and Refunds
Cancellation Policy:
- Cancellations made 7+ days before the event: Full refund
- Cancellations made 3-6 days before: 50% refund
- Cancellations made less than 3 days before: No refund
- No-shows: No refund
Refund Processing:
- Refunds are processed within 7-10 business days
- Refunds are issued to the original payment method
- Processing fees may not be refundable
Event Cancellations by Us:
- If we cancel an event, you will receive a full refund
- We may offer rebooking options for alternative dates
- We are not liable for travel or accommodation costs
5.4 Ticket Transfers
- Tickets may be transferable to another person (contact us)
- Transfer requests must be made at least 48 hours before the event
- Transfer fees may apply
6. Intellectual Property
6.1 Our Content
All content on Elevate Horizons, including:
- Text, graphics, logos, images, videos
- Software, code, and technical elements
- Event descriptions and materials
- Trademarks and branding
is owned by or licensed to Elevate Horizons and is protected by copyright, trademark, and other intellectual property laws.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to:
- Access and use the Service for personal, non-commercial purposes
- View and print content for personal use only
You may NOT:
- Reproduce, distribute, or create derivative works
- Use our content for commercial purposes
- Remove copyright or proprietary notices
- Reverse engineer or decompile our software
7. Third-Party Services
7.1 Integrated Services
We use third-party services including:
- Google OAuth: For authentication (subject to Google's Terms of Service)
- Payment Processors: Paystack (subject to their terms)
- Analytics: Google Analytics (subject to Google's Privacy Policy)
- Email Services: For notifications and marketing
Your use of these services is subject to their respective terms and privacy policies.
8. Disclaimers and Limitations of Liability
8.1 Service Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness
- Uninterrupted or error-free operation
8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVATE HORIZONS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or goodwill
- Service interruptions or technical issues
- Third-party actions or content
- Unauthorized access to your account
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify, defend, and hold harmless Elevate Horizons, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of others
- Your content or conduct
10. Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.
12.2 Dispute Resolution
Informal Resolution: Before filing a formal claim, contact us at declercq@advanced-digital.co.za to attempt informal resolution.
Venue: Any legal action must be brought in the courts located in Johannesburg, South Africa.
13. General Provisions
13.1 Entire Agreement
These Terms constitute the entire agreement between you and Elevate Horizons regarding the Service.
13.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
13.3 Waiver
Our failure to enforce any provision does not constitute a waiver of that provision.
13.4 Force Majeure
We are not liable for delays or failures due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, government actions).
